The IPP Process & Employment First Policy
Background
AB 2424 is based on the priorities of people with developmental disabilities, family members, advocates and other stakeholders, obtained through extensive community input. Meetings were held in 2006 pursuant to SB 1270 (Chesbro) to receive public input on ways to expand opportunities for people with developmental disabilities in the areas of employment and community participation. A resulting May 2007 Report to the Legislature and the Governor included recommendations for improvements to the transition services planning process for students and to the Lanterman Act Individual Program Plan (IPP) process. It also recommended policies and ideas to expand employment opportunities for people with developmental disabilities.
Summary
AB 2424 will update the Lanterman Act to make sure that individual and family participation is more effective in the IPP process and to promote integrated employment and other integrated community activities.
The IPP Process
- Make sure regional centers provide information prior to and at IPP meetings about integrated living, employment, and community participation options to enable people with developmental disabilities to make choices.
- Require that IPP teams consider correct integrated supports and services, based on needs and preferences, before thinking about segregated, disability-only alternatives.
- Require that general information about benefits planning and integrated options for employment, postsecondary education, volunteer activities and living arrangements be talked about at IPP meeting for individuals over age 16.
- Require that IPPs identify the steps to be taken to obtain preferred integrated services and supports that are not now available.
- Require that copies of completed IPPs be made available in the person's primary language.
- Create the standard that supported living services be made available throughout the State.
Employment First Policy
Create a statewide Employment First Policy to increase the number of Californians with developmental disabilities who are productive, pay taxes, and are more self-sufficient and take part in their communities, to the extent that funds are available.
- Transition aged youth, 16 to 22 years of age, and working aged adults, 22 to 64 years of age, with developmental disabilities have services and supports to achieve and maintain gainful employment at or above minimum wage in integrated community settings.
- People who directly support employment options are to be well trained and make a living wage with benefits.
- The State will measure progress in moving towards more gainful employment for people with developmental disabilities.
- Regional centers will have expertise in benefits planning.
- Methods will be created to identify best practices and funding sources, and to recommend steps to improve the Employment First Policy.
Stakeholder Task Force
Create a task forces convened by the State Council made up of individuals with developmental disabilities and their family members, advocates, public and private employers, regional centers and their employees.
- Review and give ideas every three years about department regulations and vender codes that support or hold back the Employment First Policy.
- Identify payment incentives and possible funding sources to motivate provider organizations to offer integrated employment supports.
- Review and make recommendations to the legislature on methods used by others states to increase funding to support integrated gainful employment and school-to-work transition services.
- Identify barriers and best practices of the Employment First Policy.
Consumer Advisory Committee
Create the Consumer Advisory Committee organized by the State Council to report on the effectiveness of the Employment First Policy.
- Gather public input regarding the Employment First Policy and report annually to the Legislature and Governor.
